Looks like USCIS people need more concentration while working on cases -or- my lawyer didn't sent all documents i sent with petition. I got 5 freaking RFE's for my H1B. Here goes the list... 1. Maintenance of Status (needs to check if im maintaining valid F1 status now) 2. Full course of Study (my Masters is in chicago and im in california now on STEM OPT) - (records indicate beneficiary is still doing Masters (WTF) but living in california which is not considered as commutable) 3. CPT (provide CPT docs) - already provided 4. OPT (provide OPT cards, job description during all OPT employements).. provided already.. whats wrong with them !!!! Now it gets crazy AF 5. Multiple years of practical training at same education level (so im in my 4th year of employement .. 1st Year CPT (less than 12 months), 2nd year is normal OPT 3rd , 4th .. STEM OPT They needs clarification if i did anything more than i needed.. (attached pic) I know no one here is lawyer and i need to consult ask lawyer, but any heads up or similar situations may be helpful.. becuase is saw few denials on number 5 RFE last year on other immigration forums.
The directive from the Trumpanzee is to reduce immigration. The USCIS reviewers are trying to find any technicality they can to deny your application.
In all honesty, Number 5 seems a problem, how did you manage 4yrs od employement on CPT/OPT, isn’t the max 30months
So my school provides to do employment in CPT for 364 Days (1 year before grad) Then.. Initial OPT (12 months) stem OPT (24 Months) = 4 years.. This is why we all got 5 years F1 visa right?.. 2 MS, 1 OPT, 2 STEM OPT Its only i added 1 year CPT during 2nd year MS.
Well, 1yr CPT in a 2ys Masters program, followed by a 30months OPT, read it yourself and decide how that looks. If the CPT was for a 2-3month internship then its a different matter Else it feels like you were working more and studying less
Your 12-month CPT was done in another state than the state your school is in?
Nope, same state.. just in suburbs (15mi).. commuting from same apt too.
Hmm. They seem to be saying that you got two Master's. If that's not the case, they either read it wrong, or your lawyer is an idiot.
Did you notify USCIS/ your University every time you moved? You are supposed to
Yea i have a online portal in university (with list of changes) and also receipts everytime i made a update. On employer change, address change etc.
When you move for internship do you have to update address
Wow, 1 year full-time masters let's you work for 4 years as a student!! No wonder they are pissed
Its 2 years Masters.
For 2nd year MS .. i did took courses too and worked at same time (part time student).. but completed credits as needed. Yea i know they r pissed but its what they provided.
You can’t be a part time student. You need to be a full-time student. The exceptions are rare. But if you had enough credits to be considered full time it’s ok. But yea seems like there are a lot of red flags
What university?
I'm at similar situation with you. Have you got any updates from USCIS already?
What happened of your case, got approved?
What doc do u submit for maintaining status?
All sounds legit. A fact that you gave it to your lawyer does not mean it was submitted #1 makes sense. #2 school could screw up updating the record #4 not required in a basic application
