Hi community,
My GC process was initiated with Amazon through Fragomen a month ago and i know it takes around an year from start to finish!
I’m an L4 and thinking about Canada PR as well since i have only 2 years of H1 left.

Details:
Indian
Currently on H1B- Used 4 years in previous jobs
No approved I-140 yet
CSE-1

Thoughts?

    Details? Country of birth? If you are Indian, then there is no point applying for GC yet, as if you have approved I-140 and didn’t get H-1B, then you wouldn’t get F-1 in future, as F-1 is not dual intent visa.

    On the other hand, if you are from RoW, then you may get GC before H-1B.

      Stick around, if I-140 gets approved, you can stay, if not, go to Canada. At least you don’t have to live with the fear of getting kicked out of country often. All you can do is stay as long as this country wants you.

      So yes, wait it out, is the best advice you could get.

    I have a Canadian PR. So far I have tried twice to move to Canada and chickened out. The job market is shit and getting a rental is a challenge in itself. If you are in Seattle, you can live in Surrey on Weekends to keep your residency obligations. Understand that you might have to file taxes at both places.

    Are you married to someone not born in India or China? If so you’ll be able to file under cross changeability which allows you to file as RoW. This means you are not subject to priority date BS that comes with being Indian born.

    TBH under current gov, you would be hard pressed to get GC within a yeah.

    I-140 should let u extend indefinitely, though if you switch jobs you’ll have to go through PERM process again.

    Finally pay for outside council. Fragomen are garbage and are run by paralegals. Don’t be cheap. It’s worth paying someone to explain in depth your options. With Fragomen YOU are not the client, Amazon is.

  • Depends on the country of birth. Also if you get I140 approved before h1 expires .. you can have unlimited extensions
