I got an offer last week from a company in the Bay area. I told them about the USCIS premium processing ban before the interview and they told me that they were aware of it and asked me to proceed with my interview. They would be starting the visa transfer process the coming week. Should I reach out to the HR department in the company and inform that I would be able to start working as soon as my transferred gets approved and not after I get the receipt notice? I am very skeptical about starting working for the new company on the basis of the receipt notice keeping in mind the current situation with straight rejections and slow processing times. Any advice?
Theoritically, you can start as soon as the receipt is issued. An experienced immigration attorney should tell you that there is a risk doing that, if for some reason the application is rejected then you are facing removal procedure. Furthermore, there was another recent change that USCIS doesn’t do RFE anymore, either pass or denial.

The safest way is to wait until February when the premium processing is back. We are hiring and found new candidate but we are wiling to wait for the safety of H1 beneficiary. So I totally understand your frustation.
Joining on receipt feels risky now. Check with your new immigration attorney, but I wouldn’t do it.

The new employer are asking me to join as soon as I get the receipt notice and they are not willing to wait for the approval notice...I am really confused now
If your Visa is denied, you will be in soup, not the new employer. If you are willing to take the risk, go on. Else try later after premium processing opens again.
Mid to large companies have lower risk I think. What sort of a company do you have the offer from? Also, ask them how they will support you if the eventual outcome is unfavorable (some companies send such employees to Canada and bring them back on a different visa)

Seems like a wise thing to do. Join on receipt if you are ready with bags packed if the transfer is rejected...
On receipt or not.. Rejected you go home.
