I have an approved I-140 from 2015(done by Accenture). Now if I change jobs and Accenture decides to withdraw my I-140, will that anyway impact my future H1B extensions? Assuming the new company did not do any GC paperwork during the first 3 years, can they extend my H1 for another term. Or they are required to get I-140 approved in those first 3 years. #h1b #perm P.S. : I know the rule 180 day rule for revocation and I am safe on that side. Just don't know if I can still keep extending h1 based on withdrawn I-140.
I think there is no withdrawal for I-140, this is the first time I am hearing about I-140 withdrawals, I had my I-140 processed multiple times by multiple employers. Each time the latest employer uses the the very first approved I-140 date only, also when ever any new employer files for new visa they simply ask for an approved I-140 and the priority date in that first approval.
An employer can withdraw their i-140 anytime, effectively saying they don't sponsor the employee anymore. The rule is that once 180 days are past approval, the withdrawal doesn't result in revocation, so your i140 remains technically valid.
OP mine approved a while ago, not sure if this rule was there back then. anyway the previous employer's I-140 does not impact future H1, you will get 3 years of extension without any issues. make your next move with confidence.
Can get revoked if USCIS considers it as a case of fraud.
That's a different scenario. I am only concerned abt employer pulling it back and the impact it has on h1 extensions.
not sure about that case.
No impact ...
Then new employer doesn't need to do perm and i-140 until your PD becomes current, correct? So can your New employer extend your visa every 3 years without doing their due?
the new employer can extend the visa every three years but for the green card process - the whole process starts over - ads, perm , I140. remember you need to have the perm approved by the time your PD becomes current, also perm takes a bit of time and can not be expedited. but I140 and I485 can be filed concurrently if you had the approved perm.
Hi OP, Did you end up changing jobs? I'm with Accenture, and recently got my I-140 approved (sep 2020) and now they are asking me to repatriate because of their BS 10% Improve Performance policy (even when I'm part of a project which is confirmed to be there for next 3 years). I am trying to change jobs right now as I don't want to repatriate and be on mercy of Accenture to bring me back after an year or so. My question is: Does Accenture usually withdraw I-140s? I've heard that employers do not want to take that hassle. As it is less than 180 days.. I am bit scared. Upon discussing with Attorneys, it looks like i will be able to get an H1B Transfer to new employer(with 3 year validity) based on current I-140, after which I will join the new employer, minimizing the risk that Accenture withdraws this petition.
@proxy89 did you end up changing companies and did Accenture revoke your I140 or you continued to use the same? @ilLD88 Any updates from you, for I140 ?
When you left accenture with an approved I-140 did they asked for any reimbursement? I assume you were on GCP.
@Proxy89 did accenture revoke your i140 , i am in the same boat as you

As long as it’s more than 180 days since approval, it does not matter. You are safe.
Yes, it has been approved for almost 5 years. God, when will this torture end? Thanks for your reply.
