Anyone who has worked for 5-10 years outside USA can easily reach the minimum base pay criteria compared to a new grad,
This ruling does not address that issue, it encourages ppl to get as much experience/skills outside USA before applying for h1b visa hence skewing it towards older professionals
As I said new grad base salary falls in level 2 for most high paying companies mentioned above with base being around $120-130k -140k which is definitely level 2 (level 3 starts at $145k in bay area).
How many high paying companies pay $145k+ in bay area for new grads? Very few.
A lot of the compensation is equity based which companies can translate into base pay if appropriate time was given. This RSU/bonus structure has built the silicon valley and this is how talent is attracted to Bay area and Seattle where pay is competitive due to high paying jobs in terms of equity.
I personally dislike the fact that there are industries that don't pay equity to their employees and just get H1b because they have met the base pay for their occupation.
And no these doesn't bar witch because they can file for programmar analyst and what not and get the level 4 wages for these positions. There is no mechanism in place to check if WITCH or body shops will game the system.
Don't steal that away from them using your higher base.
You and I should come to a conclusion that the best option is to expand the H1B cap. As you said it's pointless discussing here. I genuinely wish you luck and hope you get your H1B visa.
