hi all, could use some advice here. my current company (been with them for 8 yrs) applied for my H1B extension. that extension petition has been issued an RFE in the mean time, i have been job hunting and have an offer that o have accepted. is it ok to file for an H1B transfer with the new company while my current company is working through the RFE for extension??
Technically yes. But I waited until my extension went through before filing a transfer. That was my attorney's recommendation. (I did not get an RFE though)

As long as that extension is NOT a bridge. If it's a bridge, it better gets approved

Let's say your current status has expired and all you're holding onto is the extension receipt. That extension better gets approved, because I think any subsequent request (extension, amendment, transfer) is contingent on it

Technically speaking.. there's nothing called a H1b transfer. It's a new H1b petition for a new job with new employer. I would say better to file with new employer. RFE with current employer is a red flag. Do you know what the RFE is for? Also if new employer is filling with higher pay and higher job minimum requirements, you have better chance of getting that approved than getting the RFE cleared.
Just got the status today on the site, still waiting for the lawyers to get the RFE docs
Unfortunately sometimes it takes up to a week to get it
So two petitions in parallel one for H1B with the new firm(which will include H1B extension as well) and one within current company for RFE response is fine

Yah been thinking about it for a while. The eternal wait for GC while other Nationals get citizenship in literally 3-4 years.. The fear of being denied entry every time we leave the country.. or RFEs during visa renewals.. I honestly don't know why I'm here. *SMH*
Is the H1B RFE/Denial an equally common occurrence in LinkedIn/FB/<Well known prod/tech companies> as well? I thought it was mostly a consulting side nightmare as we have to get documentation about project and client contracts and such. How common are RFE’s in LinkedIn/FB?
