H1B layoff - Potential next steps

Oct 24, 2020 7 Comments

I needed pointer for folks who might have been a similar position. Basically I have option to continue at LinkedIn in a materially different role (say Engg.) or take a severance package. I am currently in sales productivity (sales ops).

The new role is not a promotional but same salary as my current role. I am on H1B, and I suspect transfer to this new role will have some immigration challenges. (Company will file for H1B amendment/transfer). In current scenario, I am apprehensive about successful visa transfer.

It feels like if I stay, I might be be out of status (upon denial) in 2-4 month.

Any thoughts on going the severnce route. I am confident of getting an offer within 60 days grace period , whoever how will visa transfer work in case of termination?

Thanks.

I would take the internal role at LinkedIn and start looking at the same time outside as well. This will give you enough time beyond 60 days. Trust me 60 days is not that much time to find the right job. You might have to take the one that comes first and may not be the best or close to what you were looking for due to time limit and holidays are near as well. If you find a contract role, H1B transfer might be an issue as well. Some companies don’t allow you to join on just the receipt but want an approved I-797. Look into all the factors before you decide.

Now with new H1 rules, things are very difficult. So my suggestion would be stay at same company for a while

I worked in Sales Ops and Engineering. I would go back to Engineering any given time. Work life balance is better and pay is far better on Engineering side compared to Sales Ops side. You’ve a layer b/w business and Engineering which will act as a shield when layoffs or budget cuts are announced.
