Will be speaking to new employer's attorneys but i figured this might be a fairly common scenario for folks on visa so I'm asking here as well - H1b stamped with company A currently, transfer approved for company B, awaiting approval notice from them. Can i quit current gig, travel for 2 weeks and come back to join company B? Will i need a new visa stamped for company B to enter the US? I'll provide new i797 on entry and show old company's paystubs if asked for. My passport is expiring in less than 6 months so i know for a fact i will need to get my passport renewed before i re-enter.
How long is your current Visa valid? If you are not getting a new stamp, that will be your entry document and new I94 is your last date of stay.
Current visa is valid until Jun 2021.
No need of new VISA stamp but if I were you, it's safer to join new company early 1st(talk to hiring manager/recruiters) and take unpaid 2 weeks vacation after working for a week.
If you go for visa stamping you will have to renew your passport since it's valid only for <6 months. On the other hand, without a renewed passport and new emp stamping, you might face some questioning or annoyance at CBP (depending on the officer) because of your passport validity and visa status. I would say you are taking too many risks. Can you take a vacation with your current company, quit after coming back?
I already have h1b with current employer stamped. I don't think I would need to go for visa stamping again? To answer your question, I can take vacation with current company and then quit but that would be equivalent to burning all bridges. Want to avoid doing that unless absolutely necessary.
Visa with new employer's name. Technically, whenever you change an employer you have to get a new visa, but people have been able to enter with their existing visa.
