My company filed H1B this year and it’s approved. But there’s been significant work force reduction and I was a part of it too. I am currently on OPT and it will expire on Oct, 2021. So, I’ve another chance to file for H1B.
Now I’ve a few questions -
1. Can a new employer file a petition to transfer my H1B before the start date by making a strong case as I was laid off? or I don’t ask them to file a petition and continue with my OPT So, my OPT doesn’t get affected?
2. How will it affect my OPT in case the petition was denied?
3. Shall I ask my previous employer to revoke my H1B so it doesn’t affect my SEVIS? As of now my SEVIS will auto terminate on Oct 1st.
Any insights would be really appreciated.
