I am a US citizen. My wife got laid off on 6/28 but we got married and did a concurrent filing couple days ago for i130 and i485. Technically she's in status right now due to the pending i485, but won't get her EAD for at least another 4-5 months. I understand there is a 60 day grace period for h1b after a layoff. Would it still apply in this scenario? Can my wife still get a new job that's willing to sponsor her h1b even AFTER the 60 day grace period (but before she gets the EAD)? Her h1b doesn't expire until Sept 2021.
Since she has status via you, there's nothing to worry. A new job can sponsor her any time. The 60 days limit is to leave country if you find yourself out of status.
Got it thanks!
You're welcome!
Hey OP, sorry for commenting on this 3 year old post but, what was the correct answer to your question? I know someone in a very similar situation right now

Correct me if I'm wrong, the 60 days are roughly until 8/28 so she still has a month to find a job. I've recently read about cases approved after 60 days too
