My H1B transfer to Uber got approved but I do not want to join it anymore and stay with Microsoft. 1. Can I still stay with Microsoft? 2. What would happen to the H1B petition with Uber which got approved? 3. Can Uber sue me because I cost them money here? Reason for not joining Uber anymore is Im scared of layoff in this visa situation.
All employments are at will. So, you don't need to worry other than getting blocked from that company
No need to be scared. I've done this in the recent past. You should have no problems with Visa. No scope for suing. Again, not legal advice.
OP 1. What is your TC at msft and what uber offered you? Role and yoe as well pls 2. Why you don't want to join? Any specific reasons?
Why not go to Uber? I'd assume they're paying you way more
Worst case you will be blacklisted from Uber for a couple of years. Other than that you are fine. The way Uber is going, it seems like its blacklisting itself.
Company can't sue. H1B rules clearly state that employer has to pay for expenses including the legal fees. Only exception is the premium processing fee that either party can pay. It will be illegal for Uber if they ask you to pay up any other part of the total expenses. Been there done that myself. The worst that will happen is that they will blacklist you. But you also have a valid case, so they may not. They may ask you to return the premium processing fee of 1225$ though. You should probably offer to return that money yourself as form of appeasement.

1. You can still stay in Microsoft 2. They can withdraw that H1B, nothing wrong happens to you 3. No they can’t sue you Reason is valid concern but may be Uber will block you from hiring again, that’s the only thing they can do, rest is fine. Note: it is not a legal advise, just personal knowledge and opinion.
How do you know they won't sue him for expenses? Have you read the documents he has signed?
yes, and you think a company has the time to recover 5000$ from a candidate who's not joining them... ideas in your head
