H1b transfer approved but dont want to join

My H1B transfer to Uber got approved but I do not want to join it anymore and stay with Microsoft.

1. Can I still stay with Microsoft?
2. What would happen to the H1B petition with Uber which got approved?
3. Can Uber sue me because I cost them money here?

Reason for not joining Uber anymore is Im scared of layoff in this visa situation.

    2. They can withdraw that H1B, nothing wrong happens to you
    3. No they can’t sue you
    Reason is valid concern but may be Uber will block you from hiring again, that’s the only thing they can do, rest is fine.

      Because organizations cannot legally charge a candidate for visa fee or other fee incurred for visa sponsorship. USCIS does not allow that.

  • No need to be scared. I've done this in the recent past. You should have no problems with Visa. No scope for suing. Again, not legal advice.

    Company can't sue. H1B rules clearly state that employer has to pay for expenses including the legal fees. Only exception is the premium processing fee that either party can pay. It will be illegal for Uber if they ask you to pay up any other part of the total expenses.

    Been there done that myself. The worst that will happen is that they will blacklist you. But you also have a valid case, so they may not. They may ask you to return the premium processing fee of 1225$ though. You should probably offer to return that money yourself as form of appeasement.

    Worst case you will be blacklisted from Uber for a couple of years. Other than that you are fine.

    The way Uber is going, it seems like its blacklisting itself.
