H4 EAD renew alternative
Currently h4 and ead is taking over 10 months to renew. This puts spouse in danger of losing jobs. I was wondering if the same company can apply for a new h1b instead of a renewal. If h1b changes location or some material changes, then usually people go for amendment. Instead what is they apply for new h1b. Will that work?

1. Can an H4 apply for H1B? Yes. 2. Since 2017, the USCIS stopped doing deference in case handling. Previously they assumed that previously decisions made by the agency were correct. Now, each extension, amendement, transfer is handled the very same way as a new application.
If that's true does it mean after 2 years when I have 1 more year left on h1b I change location which results in a h1b amendment i will end up getting a new h1b for 3 more years. Also along with it an h4 for 3 years with an EAD?
Each time you file paperwork with the USCIS, you can generally request they extend it to either three years or all the time left you your H1B status.
