Hacking the Immigration System

There's so many posts here arguing and complaining about the visa process and the immigration system in general. Most of us had the misfortune of being born in India and being subjected to long wait times. We need to take control of our lives and stop depending on the mercy of a senator or a visa officer. Here are the steps to alleviate your suffering.

Step 1 : Try your best to get an H1B. Exhaust all your attempts ( during OPT , CPT etc... ). When your on H1B, put constant pressure on your employer to do PERM and I-140. If you can't get a H1B despite multiple attempts, work for a smaller consultancy ( there are tons of them ) and make sure they directly apply for your I-140. Stop believing this non sense that you can never get a tourist visa after you get an I-140. You do not show any immigrant intent for just simply getting an I-140. Forget about the category ( EB2 or EB3 )as it is irrelevant to you. Just get the approved I-140.

Step 2 : While you are going through Step 1 , apply for Canada Express Entry. This process takes 6 months to 1 year. Complete your landing process and get the PR card. When your in the US, apply for mortgages. Banks will give you mortgages regardless of your immigration status. Buy 1 or 2 condos / townhouses and leave them for rent. Make sure you are able to get a positive cash flow with the rent after accounting for the property management company. Invest in stocks / cryptos. All of this is perfectly legal when your on F1 , OPT , CPT , H1B , H4 or any other visa. Build your sources of passive income and investment portfolio. Stay as long as you want in Step 2. Stay until you reach your financial goals. Fall in love. Get Married. Have an American baby. Don't worry about immigration. This is the step when you will have maximum disposable income.

Step 3 : Move to Canada as a permanent resident. Try keeping your US job if they will let you work from home with occasional travel. If you want to make more money in Canada, self incorporate and become an independent contractor. I personally charged 70$ per hour for my first consulting gig in a small Canadian city. If you can avoid living in GTA or GVA , consider yourself extremely lucky. The cost of living is very low in smaller Canadian cities. Live in a border town ( Abbotsford , Windsor , St Catherines etc... ). Keep your H1B and work across the border. If you get a Canadian job , then get yourself a B1/B2 visa. The visa officer this time will be friendly and nice to you. Your approved I-140 will NOT be used against you. You will not have any flutters in your stomach when you stand in line. Border control will literally take 10 seconds. Go to the USA every weekend for shopping. You will not miss a thing. Save and invest aggressively in Canada. Buy properties and leave them for rent. Student rental properties are cash cows in Canada. International students are pouring in here and you can capitalize on that. You will already be getting some passive income from your investment properties in the USA as well. Take care of your parents. Bring them on a super visa. Keep them for several years at once. Apply for their PRs ( slots open in January every year. This wont last forever apply soon !! ). Fall in love. Have a Canadian baby. You will have less disposable income than Step 2. But you can compensate by doing side hustles and such.

Step 4 : Complete 3 years in Step 3. Apply for your Canadian citizenship. Takes about 9 months. Get your Canadian passport. Now you are a Canadian citizen with an approved I-140.

Step 5 : Reclaim your American dream. You are now free to enter the US visa free. Border control will be nice and friendly. Apply for jobs and interview aggressively. You do not have to go through H1 lottery any more since you have an approved I-140. You do not need a H1b visa stamp since you have a Canadian passport. All you need is an approved I-797 and you can enter the USA with your Canadian passport and work. You can also take the TN route , but this is a little risky and highly discretionary by the CBP officer. None the less , your options for working in the US have multiplied just by virtue of you being a Canadian citizen. Your properties in both countries are now worth much more and bringing you a lot of passive income. If your H1B renewal fails , go back to Canada and try again. Remember that you don't need a visa anymore to visit the US for any purpose.

Step 6 : Wait for your I-140 date to become current ( 15 years , 20 years , who cares ?? ). Apply for consular processing. Go to the US Consulate in Montreal and give your interview. This is way faster than applying for an adjustment of status I-485. These interviews typically can't go wrong. Get your case approved.

Step 7 : Enter the USA as a permanent resident and live happily ever after.

Note that Step 6 and Step 7 are not guaranteed. Many people find happiness in Step 4 or Step 5 and live happily ever after.

Personally I am in Step 3. One more year to go for my citizenship :D

      Not an exaggeration, an underestimate if anything. Most people getting in line for EB2/3 today will get LPRs when their US born kids turn 21 and sponsor them

    Instead of this, pin hopes on swades movement. Go back home and build something. Especially if you are from India. India is at a place where China was few decades ago. With proper investment you will live way way way better life doing meaningful things in india or your home country than hopping in this ocean of uncertainty between two countries and working for same companies on same old CRUD applications

    Assuming everything stays constant, which it won't. This plan relies on everything going perfectly. Anything going off and everything comes crashing down.

    Let's say Canada goes the UK way for international students. You're now left holding subpar properties in Canada. Also, buying rental properties in the US today that are cash flow positive from day 1 - not gonna happen.
