How is h1b still a lottery??

Jan 21, 2019 24 Comments

Everyone I have talked with is busting their ass to get a job on opt. 90% of companies won't interview if need sponsorship. You are then left with leetcode companies who aggressively interview. Seriously after so much struggle how is it a lottery

They flood the system with multiple application per person, that's how they screw the system. Their database administrators get H1b while ml engineers at Google don't make it into the lottery. Consultancies should be banned, period

    • That’s a higher lobby, unfortunately. Dems will never let it happen

How are there ANY spots available in h1b lottery at all? There are only supposed to be 85,000 h1b but last I checked there were 600,000+ h1b holders.

Should not they all count against the quota? Seems h1b is very over subscribed. Just because they are exempt from the lottery shouldn't mean they aren't using up a visa number.

This over subscription is also the root cause why India greencard queue is too long.

You don’t understand how it works. The law states every year 85k new h1b are given out. New, so the total number of outstanding h1b visas will be much higher.

Australians are lucky that they get a special type of visa just for them (E3). Saves having to deal with the H1B nonsense.

    • Same for Chileans, Singaporeans, and Canadians.

Australians are not lucky. E3 is part of the free trade agreement between the U.S. and Australia.

Each year 85K are given. Rest are from previous years. Some have I140 approved so h1b for life.

Actually most countries are below their greencard quota.
      Jan 21, 2019
    • @AforEmily not necessarily. Eastern Europeans don't the numbers that India has. If not India it might be nobody else.
You will notice that each time there is a backlog in the AOS queue for other countries, over time the backlog decreases and eventually clears, meaning less applicants.... But for India over time the backlog increases.
