Hi, My lawyer filed the concurrent petition for me yesterday (I-140 & I-485 forms). How long does it takes for Nebraska to process the I-485. I use premium processing for 140. From the website https://egov.uscis.gov/processing-times/ 27 Months to 37 Months Employment-based adjustment Do i see it correctly? I thought it only takes 9-24 months, so if someone is lucky, they can get GC in less than a year. But now, it takes more than 2 years for AOS. It is insane. On the other hands, some websites show different estimations. Which one should i trust? Also, i am on L visa. After 6 month after 140 approval, can i change job (after receiving EAD)?
We filed our AoS at Nebraska center end of August last year. It was transferred to NBC in February and as of April, the status website says they are ready to schedule interview. Not from India or China.
Took 8 months for me to get scheduled for interview. Concurrent filing, I140 premium processing, EB3. Yes, you can change jobs on EAD after 180 since the receipt date.
Even when i'm in L1 visa type? Also, when did u file the visa application?
I'm also on L1. Visa type makes no difference. I assume you're asking about green card application. Filed August 2018 in Nebraska. We're in very similar circumstances. I'd say you should be more optimistic. Unlikely to take 24 months. The higher end of the time frame is the time it takes to process 93% of applicants.
Hard to predict. The only case I have for reference from Nebraska was as follows: Filed: Nov 2018 Fingerprinted: Dec 2018 EAD/AP arrived: Jan 2019 Interview date received: Mar 2019 GC interview & approval/card delivery: April 2019 Interview wait times are driven by your local field office, not Nebraska, since you’ll interview at your nearest place. For you, that’s probably the Seattle field office down in Tukwila, near the airport. Hope that helps.
Also you can transfer to a similar role, 180 days after the receipt date of your I-485. Assuming you have an EAD card. I-140 gives no immigration / working benefits what so ever. Premium processing also doesn’t affect I-485.
I have a similar timeline as yours up to the EAD/AP arrival. Haven’t get the interview date from them yet... wondering if this is related to country of birth?
8 months to get your interview scheduled. Another month to get gc in ur hand
It should take an average of 8 to 10 months for you to get interviewed. Good luck.
Can you concurrently file I-140 and I-485 and request premium processing for I-140 in it? Or I-140 must be files alone in case premium proceasing is requested?
If your country is current, you can file 140 and 485 concurrently. Anyone can file for premium processing, but it won’t really benefit you too much if your country is current. Cases don’t have to be filed separately to get premium processing on the 140, but be aware that premium processing has no impact on 485.
You can file I-140 in premium even if your country is not current and you are filing concurrently.
Yes my pd is current. If I get I-140 approval via premium when doing concurrent filling, I get the I-140 approval and I can switch job after 6months. But with concurrent filing with I140 regular processing, it seems I need to stay longer (I-140 pproval plus 6month) at my current company. My attorney was saying premium process of I-140 is not possible when filing I-140 and I-485 concurrently.
Not true. I did that.
Premium processing is possible when filing concurrently - it just doesn’t provide much if any benefit. The benefit is when you don’t file concurrently, you reel in that second part (I-485). But when filing concurrently, they run in parallel anyway so the I-140 being adjudicated earlier doesn’t have much/any impact on the overall timeline. Also the 180 day job change timer (AC21) is tied to your I-485 receipt date, not your I-140 approval.
Thanks @mr_pleb & x64. Good to know that 180 day job change timer is tied to I-485 receipt date (not I140 approval). Well I still think I140 premium could be helpful. In case I140 application is not approved in 180 days or ends in rfe/denial, I cannot move to new job. So will probably request I140 premium processing in case attorney's office let me..
Yeah, go for it. I mean it only costs just over 1k - nothing for Wells Fargo.
I had the same reasoning for PP and I had to pay out of pocket cause there was no urgency. It is $1410 now. They sent my application right before the fee increased, PP got rejected, had to mail new check. With all the back and forth it took a couple of months to have the I140 approved even with PP. It's exactly this kind of USCIS fuckery I wanted to avoid by choosing PP. It's still worth it to reduce the chances of being gated by it in the current immigration context when things can change over night.
How long did your PERM approval take?
It took me 4 and half months
