How much notice should I give?

NEED SOME URGENT HELP ON THIS I am starting a new job in slightly more than 3 weeks from now (probably first week of October). I am on H1B visa and my Visa is already transferred and approved. When should I tell my current employer about leaving? I am planning to travel overseas to get the most out of notice period. Is 3 weeks too many and I should wait one more week or I can tell them now. Concern I have is, will they put me on payroll for entire 3 weeks if I tell them today or tomorrow? PS - I am joining a competitor.

2 weeks is the standard

Thanks Considering my tentative joining date as 7th October, I should inform them on 18th or 19th But what if I tell them tomorrow Will they allow me to be on payroll for 3 weeks. Btw I work at Microsoft as well.

Yes 3 weeks is not too much and if you set your last date as 3 weeks from now, that should be fine too. Generally you got the right to decide the last date in these cases

Usually it's two weeks in USA unless you have unfinished tasks or projects that are dependant on you...so you can wait for another week and let them know that you are giving notice of two weeks

Is 3 week not allowed in industry ?

Intel no_rsus OP Sep 12, 2019

I don’t have much of the transition needed since I am ramping up on new project

Why does it matter if you are on payroll for the entire 3 weeks or not? You gave them plenty of time and if that is their choice then so be it. Use it to your advantage.

I will loose the salary of 1 week and be unemployed for a week on H1B visa

1 week without pay is fine. USCIS knows people switch jobs etc and 1 week gap won't hurt. Good luck.

Can't you ask your new employer to start you a week early if your H1b transfer is already approved?

Intel no_rsus OP Sep 12, 2019

Yes worst case thats the plan

Intel no_rsus OP Sep 12, 2019

It will trim down my travel a bit

2 weeks is standard but ultimately it depends on if your Mgr is cool with keeping you around. Some companies might ask you to leave sooner if you're going to a competitor (I know it happens for people moving from Amazon to Google sometimes) so up to you decide. You're ALLOWED to leave whenever. I've done 1.5 weeks before and it wasn't a big deal. You just don't want to burn any bridges so you'll need to figure out what would work best for you.

Intel no_rsus OP Sep 12, 2019

Cool Thanks Do they keep people on payroll if they ask me to leave immediately?

Amazon Ummm... Sep 12, 2019

Probably not. You could just give them 2 or 3 weeks notice and not tell them where you're going. They can't force you to tell them. Ultimately, 3 weeks notice won't be that insane. Talk to someone there and see what they think. It depends on the culture at your company.

FYI, it’s perfectly fine not to tell your current employer about your new employer. That takes out the issue of you going to a competitor.

Intel no_rsus OP Sep 12, 2019

I want to travel and I don’t have any reason for me to get my leaves approved immediately

NIO lostninja Sep 12, 2019

Sure but I meant is that you don’t have to name your next employer. You can always say I am going to a “different company” without naming which exact company.

2 weeks is standard in US unless you don't like the manager in which case give less.

Amazon ps.ily Sep 12, 2019

That’s petty, best to stay professional at 2 weeks no matter how crappy your boss/company is.

BMO hPnJ57 Sep 12, 2019

Don't need to tell them where you're going

It also depends on seniority. I'd say 2 wks is standard to early in career and first-level people managers. But if you're leading a big team or very senior or very specialized, it's courteous to give 3 or 4 weeks notice. Or maybe more. Depends on how hard it would be for your company to find a backfill.
