I had an offer from FB a couple of years ago and they refused to apply for H1 since the offer was about 4 weeks before the filing date for H1B - they refused to apply H1B for me that year. I am in a similar situation - when on my 60 day grace period. I am expecting an offer from FB but am concerned that if they learn more about my immigration status (60 days grace, with 30 spent already) they may refuse to put in a transfer request. What is FB's policy in such a scenario?
They should not refuse transfer request. If you have a valid H1B Visa stamped they can put a request of H1B transfer. The grace period has nothing to do with H1B original stamp. You will go out of status after 60 days but that's not counted as unlawful presence. You may even be able to move to fb on receipt (even after 60 days). There's no strict rules as to how many days of out of status is ok/not ok. Only clear rule is you cannot stay in the country more than 180 days which is unlawful presence. All this given your visa stamp is valid.
Yes I'm aware. But what I'm wondering is if FB's internal policy doesn't entertains such cases. As you see in my example, it was approx a month till the H1B filing date and they told me upfront that they won't do it this time around.
So they didn't want you on opt earlier? Only on H1B? I don't know why fb would do that. What if you never tell them about grace period. You can very well say I resigned and am going back to my country while you're processing my visa application. You can then come back on new I797 approval. It's perfectly valid and you can justify it easily. With premium processing you'll get a response within 2 weeks and you can move to fb on receipt. But collecting all docs and preparing application takes some time - from today to receipt may take about a month.
Well you should tell. Either they will hurry up or tell you no quickly. Either ways you get more clarity.

I have explicitly asked the lawyers about this on an occasion for a friend and they said they do sponsor such cases. If it's beyond 60 days they might even do consular processing which would be safer. The only thing they care about is that you don't have to go through the lottery.

Hi left my job after my final interviewed was scheduled . Meaning I was on job till the rounds leading upto the final round. But I didnโt explicitly mention the recruiter that I resigned my current job half way through . It was because I wasnโt able to focus on interviewes while going to work every day Espc when I had to take a complete day off for every onsite. I know it sounds silly to do something like that on H1b but I had enough interviews lined up for the month so I had confidence I would crack something . I am in the same situation where I have 1 month left on H1b . They havnt filed the transfer yet . Does anyone know if the transfer process starts after the background check or is it simultaneous ? How long does it take from signing offer till the H1b attorney contacts?
