India - I was lied to about the role. Now I am stuck in 3 month's notice.

Guys how do I get out of this ? Recruiters don't call back when I say I will need to serve 90 days notice.

    Unlike the US, 90 days notice is common in India and something people negotiate for, if you are a good candidate you can day, I will not be on a 90 days notice but 60.

    However, after you accept the offer you can't do much.

    Yes you can break the contract and jump ship before the 90 days and chances are high(almost a 100%) that they won't sue you for it, as long as you give a month notice, however they can make your life miserable by delaying the settlement check and the experience letter(this is again something unique to India, and your next employer will ask for it)

      There are innumerable litigations regarding notice... Service agreements are very crafty i won't win.

    Tell them you are flexible with the notice period and if the job is right, you are willing to negotiate a payout since the current role requires 90 days. New employer will pay out your time at current role, if they like you and are desperate enough. It was done for a someone we wanted to hire in my team.

  • Resign and then start looking for job, at the beginning only interview companies you are not very interested to gauge the demand in market. As you come closer to serving notice period you will get more and more interview invites. You will be surprised that ability to join sooner matters more than your skills. Good luck!
