Hi I hope to get some advise to my situation with my employer. I'm a contractor with my employer started 06/18 for 18 months contract, ending 12/19. Now that they have applied for my h1b and still waiting for rfe response, my client has offered me twice now for fte position but due to my visa pending, can't proceed. The thing here is that my employer asked me to sign a 2 years contract with them to prove employer-employee relationship to uscis for my rfe if I get my h1b. The contract stated that I have to pay fine $3000 per month for the remaining months when I decided to quit, the offer for the h1b contract is only $69k in Philly area. My question is if I should take fte when I get my h1b approved and ignore my employer's fine? FYI I know that my employer has sucked almost 50% of my current pay in which I get 55k per year as a SWE since 06/18.

Join the new company.
In any case, if you can afford to pay, you should dump the body shopper. See if the client, who you want to join as an FTE can give you a joining bonus which you can use to cut your losses. Given that the offer is 69k I don't see that helping much though. And , yes, gett he h1b in Trump's era on that salary will itself be a miracle
Contracts like these are illegal in US. Dont worry they wont want to screw themselves in Front of USCIS or their client if you declne to do so
