I am not ROW. I am not even considering S386. That bill is flawed. I am just evaluating my options. In the verge of getting kicked out of country after graduating from the top CS school. So I am wondering if I should apply for perm or not. Cause if it affects F1 in future, I wouldn’t want to risk because I can come back for PhD.
It does affect coming back. Best bet is to stick with company willing to help you relocate if needed. Also not sure why Indians apply for perm nowadays but that's personal choice
"Start PERM and not I-140" is not really a practical option most of the time since, if I-140 is not filed within 180 days of PERM approval, the labor certification expires and you have to start all over again (and you don't get to keep the priority date from the expired PERM). If you do decide to move to the I-140 stage to lock in your priority date asap, then it's advisable to just not travel outside the US until you get H-1B. If that fails then try to come back on L-1. On the other hand if your plan is to go back to school for a higher degree if you don't get H-1B, then it would be more risky to have the I-140 filed.
