Can I claim return of tax if company withholds tax based on office location (CA) rather than my physical location (WA) ?

I am a new grad joining Google this January and planning to work in Seattle until September. Still waiting to hear from recruiter regarding the state tax withholding policy.

I heard Adobe is going to cut California tax irrespective of the employee physical remote location. In this case, can the Adobe employee file a California tax return to get all the tax back from California at the end of financial year ?

If CA resident: No. You must pay CA tax no matter what.

If not CA resident: Yes. You can avoid CA tax on income earned while you’re outside CA.

  • Was looking up rules for CA and they are complicated. If you are an employee, no state tax on income if out of state except if you go physically into CA to work for some reason. If you are in CA, the period of work is subject to tax. Like if you fly in for an onsight meeting. If you are a contractor, you you have to pay state income tax. If you are classified as an employee, you can probably get your money back with a return but not sure how complicated it would be to file.
