Is GC EAD good enough to stay put?

My wife and I have been in the US for some time now. We both have our respective H1B from our employers. My GC PD is in 2018 and I've been eyeing a miracle in October this year where I presume that DOF might move good enough to cover me. At the same time, I've been prepping for interviews and might get an opportunity soon.

While it is just an assumption but if my PD is current and eligible for EAD, I ll miss either my offers or my EAD as my process has to start over in new company.

My question is, how good is EAD for me? I understand it will be a backup to my work visa in case my employer decides to fire me on spot and I can't secure a job in 60 days. But can't i fallback to H4 as my spouse has H1B and vice versa. It has to be a catastrophe that both of us lose H1B in same period and both cant secure jobs in 60 days.

So blind fam, help me. Is EAD still worthwhile my stay at my current job till I get it(or 6months post i485 filing) or I shouldnt be worried as EAD provides same backup as spouse's dependent visa. Am I missing something? Should I give a crap about EAD or I can just move free without worrying about it since spouse H1b is my backup

Edit: My point against EAD is that it's one more application that I have to keep following up every year with USCIS and most probably it won't be used.

Thanks!! Did not know that. But if you lose your job? Is it still 60 days to find a new employer?

60 days for your H1B but it is possible your employer might pull your I140 in which case your I485 will also be pulped and the application has to be started again

  • I think it’s highly unlikely that your PD will get current in the next fiscal even with the overflow

Get real. The dates mean very little. Indian with GC date as current for the last 6 months, no movement at all. Your PD becoming current doesn’t mean you’ll get the GC immediately- takes 16-20 months at least. Dreadful process.

Thanks for the response. The only reason I see people yearning for EAD is for the GC which won't be available anytime soon. So, EAD just provides EAD benefit only and is just the next step mentally towards elusive GC. I just don't see the risk of not having an EAD as I have my spouse's H1B as fallback (Maybe I am shortsighted as I don't know more benefits of EAD)

I think i was unclear in my post. I have my own H1B that I can port to new employer. I won't even bank on H4 EAD. I'll move to H4, interview with companies and port my H1B to new employer in case i get an offer. So, H1B -> H4 -> H1B is what I was thinking.

  • Where did you learn that DOF for India may reach 2018 in Oct 2021? Can you cite your source? Also are you EB2/3 ?

No, I am talking about hypothetical case. Forget about what happens in October. I am talking in a more general perspective
