Laid off on OPT

Posting this for a friend.. She was laid off on Friday. Her F-1 OPT expiry date was July 1st, 2019. Although she has applied to Stem OPT extension it got rejected due to filing something incorrectly.. Her H1B was picked in the lottery. It is not yet approved. I was wondering what the consequences might be? What is her visa status going forward? What steps can She take to maintain her visa status?

She is probably an illegal right now. Ask her to contact a lawyer ASAP. Blind is not going to help.

She's not illegal yet. USCIS will give her a week or so grace period to leave the country.

Which company is she working at? Can she shift internally to a different team?

Yeah... what does “laid off” mean?

Oracle techlord12 Jul 2, 2019

I meant to ask which company laid her off. Like is it Amazon that laid her off? If so, can she interview with other teams at Amazon?

Contact University immediately, why are you posting here?

H1B will be invalid even if it gets approved since it is with current company. Contact lawyers and current company if they can do anything about it. She will be out of status if she can not switch to h1b when (provided if) it gets approved.

so sad to hear that. Why would a company even do that? Give her some time to find a new job

H1-B is now invalid. Best choice is to return to the home country to avoid accruing illegal stay. Contact an immigration lawyer asap.

Go to the international student office immediately Also, possible to find on-campus employment for the time being? Some can offer J-1 sponsorship.
