Life after no H4 EAD

PE at AMZN on H1B. Given the upcoming changes to H4 EAD , I am thinking of couple of options to retain my wife’s work status .

1. Move to Vancouver Amazon and come back later
2 . Move to EU ( FB or AMZN) and come back later
3. Move to Amazon India and never come back

Key considerations
1. I have a kindergartener and I want to ensure that too many changes do not affect his social life.

2. I have 2 houses , one in in Bellevue and one in Redmond. I am thinking of selling one and retaining one. Vancouver option is better for managing this property.

Overall I do not think there are any other options left. I am interested to know what this community thinks of these options and the pros/cons.

  • Cons of going to Canada or EU and coming back:
    You are probably looking to come back on L1. Which means you will be tied to a company and it won’t renew endlessly like H1B.

    Obviously your wife wants to work and have a career. Given that H1B is for high-skilled workers, if your wife is high-skilled, she should get her own H1B instead of piggy-backing on your high-skill visa and stealing a low-skill job from American workers.

    • It doesn’t. You are confusing the visa criteria for primary applicant with basic rights that should be given to family.

      For example : L1 dependents can work, F1 dependents and J1 dépendents can also work. None of these satisfy the criteria for primary and they are not supposed to.
      On top of that H4EAD is not given right away, you get it at the point where you get approved for I140 which means you are probably going to stay in US long term and it helps economy to let your family prosper and pay more taxes.

      You're confusing a person with his/her family. Ead is a blanket permit without any preferential treatment towards locals. In most situations it probably doesn't matter but enough research has not been done. I would rather see the situation addressed holistically by revamping work visa and removing stupid things like country quotas and diversity visas.
