Anyone had luck in the past moving to Canada and coming back on EB1C or TN Visa? Esp for Indians stuck in green card backlog of 170 years what is your plan B? PS: Don't want to choose a partner just for citizenship so that is ruled out
You don't come back on EB1C. EB1C is a GC category not an immigration status. You need to come back on L1A and then file for GC in EB1C or move your current application in that queue. If you come on TN Visa, kiss your dreams of GC goodbye.
Is it possible to stay on h1b with a PR from Canada? Just to keep TN as a back up option in case something happens to h1b. I already have a priority date btw which might come in like 150 years 😂

@immiStuck Depends on how badly you prefer settling in the US. A Canadian PR will take about an year to get without touching the soil as @yue mentioned. The major blow you might come across after moving to Canada is the pay. It's about 30% lesser pay with slightly higher taxes. On the brighter side, you'll never have to depend on your employer for health insurance with appointment wait times as high as in the US. There's a Canadian joke "When a Canadian is being given hard time of being one, they go and get their feelings checked by a doctor for free". You can work multiple jobs and of your choice and face warmer greetings than in the US. ;) So, A significant pay cut would be the trade off for a promotion from a 3rd citizen to a 2nd citizen and also much closer to a Canadian Passport, freedom to work anywhere, any number of hours and also free to start your own business and so on. Also, @Passwords you don't get a TN Visa on a PR. You need to be a Canadian citizen. You can apply for citizenship after you have lived in Canada for at 3 years.

Thanks for the great post. A couple of questions since you have detailed knowledge - when you get PR, and let's say you've stayed for 3 years, the citizenship can be applied for right? How long does it take to process citizenship? - what are the rules on family (spouse and children) and perhaps parents?

TN visa lasts 3 years. However it can be renewed as many times as needed. Some people do get denied for renewals. TN visa is not dual intent. You cannot apply for green card. Also NAFTA is bieng negotiated as we speak and I would be a bit uncertain being in the states on just a TN.
Also if you have applied for GreenCard and then go via canada route get canadian citizenship and try to come back on TN, your chances of TN denials are very high, as you have already shown " intent to immigrate"
I've known people who've gone to India & come back as MNC manager, apply EB1C & get their GC in a year. I'd assume same to be possible with Canada as well. Don't complicate with PR or TN visa, just get a work permit for a year

No, if you have i-140 and from the date you leave US from h1 and while come back within 6 months, you are cap exempt. No lottery if you come back in 6 years
Do you lose your cap exempt status based on H1B i140 if you come back to US after 6 years ?

You can get Canadian PR without even touching foot on Canadian soil.
It only gets activated and sent for printing after the landing
