Hi all,

I accepted an offer from company A a month back. H1B process started and I am expecting to receive my approval notice by end of this week.

Meanwhile I interviewed with company B , they got back with positive response. I like the work and also the compensation seems to be better than what company A is offering.

I have following questions:

1. Can I start the H1B transfer process again with company B provided its already complete with company A?

2. When I provide documents for my H1B filing, company B is asking for all the past h1B docs. Do I provide company A related H1 B details as well or just my current company H1B details?

Please note that I have NOT mentioned to company B that I have accepted offer from company A and also that my H1B process has started.

Edit - i was able to file 2 h1 b transfers with both companies and finally went with company B. There were no issues with Uscis. So multiple H1B tranfer worked in my case.

  • You need to provide them with the info used to apply for your H1B along with anything you got back from the gov’t. Give B the same packet of info you gave A.

    FYI there’s no such thing as a “H1B transfer,” technically it’s a full H1B visa application that uses the current status as evidence you’re already in H1B status today.

    Getting the new visa doesn’t invalidate your current status. One company has no way to know about the other.

      @Root, so you do not have to disclose the approved I797 from employer A to employer B even if employer B asks for all previous approved H1B? Because that is what they do...

  • Each company applies for a new h1b cap exempt. It’s not a transfer.

      If they do that they will be breaking the law. An employee cannot be penalised for exploring employment options.

    • That said be a responsible person and inform employers you don’t plan on joining so they can offer someone else. Being hiring manager is tough already:)

    Legally you can have multiple H1B transfers going on at the same time, but can accept only one offer at a time. Company B doesn’t care about company A’s transfer — as company B’s legal team will directly work with USCIS on visa transfer.

  • If OP joins company B and does I9 verification, would USCIS notify company A that the H1B is invalid or OP has joined B? Urgent question. Thanks
