New Mom got laid off

So i recently got laid off and they said because of restructuring and offered a severence which is v less.My manager has been not in touch with me once i joined after maternity leave in 8 weeks.I have not been top of my game but i wanted to chat with him between for flexibility but he never had the time to connect.Should i work with an attorney or just move on and find a better job.

    Well When you have a baby u also have additional responsibility and life isn’t the same even if you want to perform .There should be some time to transition and settle

      It isn’t but laying off saying they r restructuring is probably not right .And when I joined after mat leave and wanted to connect with my manager several times he did not respond

      Why isn't that right? That's when most layoffs happen, when restructuring. Where others laid off with you? And regardless not a lawyer so talk to one just be weary of paying too much to find out.

    If you were laid off and if you can prove that the reason was discriminatory because of your pregnancy then law will be on your side. Get a attorney and land with some good settlement (make the company pay for the mental trauma)
    However, if the company can prove that the layoff was due to restructuring (like if your whole team was laid off) then the employer will have an edge. Read on pregnancy rights.

    What were your performance reviews like pre-baby? It reads like you wish you had time to ask a favor of your boss but were laid off before you could and you admit you weren’t a great performer. Were you a very strong performer, and worthy of flexible / special treatment previously?

      I was a good performer may not be the strongest one ,but I was flexible with hours ,always interested in learning new things and collaborating with peers .

    It depends on various factors. Some I can think of are- were you the only one on your team laid off ? Was your annual rating 4/5 last year or any year before that ? These can make your case stronger but of not for this, you have no grounds.

    Easiest thing would be to try talking to the HR and get more severance.

    If you are a US citizen, I would say go ahead and sue their ass.

      What can I talk to the HR about .I found out no one else was laid off atleast from the team .I have only had one review and it was above average

      You could try to negotiate your severance. Ask them for more time on payroll(since you are on visa) or more money. You could also ask for COBRA or something similar for insurance benefit.
      To have a lawyer take up your case, you will have to prove that there was a history discrimination towards you and/or have more people with similar background who were affected by the layoffs. Without any proven history, you won’t win.
