So i recently got laid off and they said because of restructuring and offered a severence which is v less.My manager has been not in touch with me once i joined after maternity leave in 8 weeks.I have not been top of my game but i wanted to chat with him between for flexibility but he never had the time to connect.Should i work with an attorney or just move on and find a better job.
You just mentioned the reason for getting fired.
Well When you have a baby u also have additional responsibility and life isn’t the same even if you want to perform .There should be some time to transition and settle
Severance is less than what? What's the other option?
lol
They offered me two weeks of salary .i was working for 4 years
Definitely attorney
i worked for a company for 1.5yrs and got 2months of severance
Generally how is the severence calculated ?
Generally the range is between 0-2 weeks per year of tenure. Some companies may be more generous.
Attorney for what?
Attorney for what I think was discrimination and no consideration for a new parent when I wanted to connect with my manager
Not an expert but don't believe being a parent is a protected class?
It isn’t but laying off saying they r restructuring is probably not right .And when I joined after mat leave and wanted to connect with my manager several times he did not respond
What were your performance reviews like pre-baby? It reads like you wish you had time to ask a favor of your boss but were laid off before you could and you admit you weren’t a great performer. Were you a very strong performer, and worthy of flexible / special treatment previously?
I was a good performer may not be the strongest one ,but I was flexible with hours ,always interested in learning new things and collaborating with peers .
If you were laid off and if you can prove that the reason was discriminatory because of your pregnancy then law will be on your side. Get a attorney and land with some good settlement (make the company pay for the mental trauma) However, if the company can prove that the layoff was due to restructuring (like if your whole team was laid off) then the employer will have an edge. Read on pregnancy rights.
This is a great point! Very true and very well said SAP!
