Reposting to get more answers:) 1) For those who are joining a new company on H1b receipt, can you use that receipt to leave and then re-enter US ? 2) If yes, When you re-enter US what I94 date can the Immigration officer possibly provide ? he has no H1b approval to decide the timeline. 3) In case there is a valid H1b stamp with old company on passport , does that help reentry somehow in above case ? As per following link this is possible ! https://www.usavisanow.com/h-1b-visa/h1b-visa-resources/travelling-while-an-h-1b-petition-is-pending-at-uscis/ But after reading more sources it looks suspect and not 100% guaranteed 4) let’s say the H1b transfer is successful. If you have visa stamped on passport via old company until 2020, there is no need to go for another stamping until then , is that correct ? Thanks
I have traveled on a receipt while the previous company H-1B was unexpired (according to I-94). I am Canadian so I don’t know the rules around visa requirements and whether you can use the same visa stamp. But in any case it’s not recommended since it can confuse the CBP agent who may not understand how it works.
Better confirm with lawyers but afaik it's not possible to enter US on receipt. You'll need a valid I797 and an expired H1B stamp on passport
I wonder if an “unexpired” stamp from old H1b and an H1b receipt might be enough.
Yes a valid h1 stamp from prev employer and most recent i797 from the new employer is enough at the poe
