Hi Guys, I am on OPT and I have two year STEM OPT extension. I got selected in H1b lottery his year. I am going to leave my current employer this month (serious issues). Can my next employer use my selected H1b case or I have to wait to next year and reapply for H1b? And If I have to reapply, do I need to go through the lottery process again in next year?
No. You will be back on OPT if you make a switch before October 1
Wait till October. Once your status changes to H1B then change employer. They can file H1 transfer for you.
Thank you all for your advices. But I have to leave very soon due to serious issues. If I have to reapply for H1b next year, do I need to go through the lottery process again in next year?
If your H1B gets cancelled, then you’ll have to apply again. It might lead to some other issues as well. What if it gets approved and you have changed employer. There are lots of if and else. I don’t know the issue that you are facing but I would still advise you to remain there till October. Maybe try changing teams for the time being. Remember that it’s a lottery and you may or may not get selected next year. Don’t jeopardize your career. It’s a matter of only few months
and an attorney can guide you in the best way in this scenario. Think it through and then take a decision.
Bro don’t do this, companies are reluctant on transferring H1 applications before u actually have it. And if you leave your H1 application is void
If it was COS, you can pay for premium processing on May 20 I believe. You'll get the result in 15 days max. The next part I'm not sure but once you get the approval in 15 days, you can apply for h1b transfer.
Your H1b will be cancelled by your employer if you do that. Wait until October.
