Passport is expiring and H1B is selected

Apr 4 15 Comments

Hi all!
My h1b was selected this year. So I’ll be changing status from F1 to H1B soon

My student visa expired back in June 2019 - but I have been on valid OPT/STEM OPT status since. COVID hit so I never left the country to renew/extend my F1

I’m from India and my passport expires in June 2023. If I renew and get a new passport here in the US- will they give me the old passport back because technically my F1 visa stamp
Expired in 2019? How will I have proof of any US visa? If there is none on the new passport- especially when I go for H1 stamping

Please let me know if anyone has been through something similar or has any suggestions. TIA!

Yes, they will give your passport back. And apply at the nearest Indian consulate. You should get your old and new passport within 1-2 weeks.

Yes they'll give the old passport
My old passport got damaged and it was going to expire within an year. The consulate returned the old passport (whatever was left of it) along with new passport
If need be you can apply for tatkal passport renewal as well

You should get your passport renewed before getting the visa stamp or travel. You can renew before one year. They will cancel and return your old passport.

Otherwise you might end up getting visa/I-94 upto your passport expiry.

Different country, but have had to carry old visas (tourist and student) on old and expired passports along with a new passport. Don't see why they would keep your old one, but you're right to ask and look into it.

Visa and passport are independent things. Valid visa can be on invalid passport

    • Yes agree. It’s the other way round for me. F1 stamp expired on “old” passport. Have to get new passport - and then get H1 stamp.
Making sure that I’ll get old passport back when I get a new one - so that there is proof of original US visa in it even though it’s expired
