Future of H1B visa

Feb 15, 2019 180 Comments

How is going to H1b visa? It’s becoming too much uncertain to work with H1b visa as there is no assurance of getting h1b extension. How can someone plan to stay long in USA with family? Is it better to move out of USA?

  • Not sure actually. Have seen h1b extension rejection with $110k + wages as well as rejection with I140 approval. Becoming very difficult to take call for longer stay

Depends on the role. If you work on export controlled or defense/DOD related projects and technology you must by a US citizen. There some new teams mainly in software and fringe products that look like they have been entirely imported from abroad though.

@RobertSwan we both have the same problem. I agree Indians should stay in India and Americans should stay in America. You help throw all Indians out of America I ll help throw American companies out of India. Look at China, they blocked all these American companies and let local companies grow. That’s y u see great companies alike baidu, alibaba etc. India has a broken system that these American companies abuse. It’s like imperialism 2.0. I want to end this and Make India Great Again.

High paying H1B jobs seems be safe mostly, at least for now. Low paying jobs are being eliminated

  • Yes it isn't intended to be permanent. Not sure why we Indians assumed that.

@ GQuE05: You basically said the same thing what kheera pointed out. Nobody is assuming permanent status on a visa which clearly calls out “temporary work visa”. This is the very reason why company’s file for their company’s really valuable employee’s Green Card regardless of which country they come from. The real ethical dilemma is the wait time - you can make whatever arguments you want against it or in favor. It definitely is a ethical debate where there is no right or wrong answer but a whole lot of grey area which you can debate for hours. I do want to point out - Spending money on materialistic things is purely an individuals prerogative. Until and unless it is allowed by law no one should question on why H1Bs are buying houses assuming stability on temp visas. They did the math and took the decision- the math was based on the fact that PDs of Green Card will by the most take 10 years for Indian citizens. This didn’t happen and hence the dilemma faced by Indian H1B visa holders. Going forward we will see less individuals on H1Bs buying houses (especially if we have Trump and Cissna’s second term) so this would not be a point of discussion.

You don't need to wait in the US, once you have your PD you can wait anywhere

H1b is a temporary visa and not intended to be used "to stay long in USA with family".

@cutter One recruiter reached me for Amazon. Gave online assessment and cleared as per update from recruiter. He said he will get back to me. It has been almost 3 weeks, I am waiting for next steps.
