EB1C queue has retrogressed by several years and isn't moving since a long time. No idea if it will be current in 2020. With an I140 that was approved 1 year ago, is it possible to (H1B) transfer to another company ? Heard that it retains the priority date once the new employer files I140 again, but what about the queue? Will it be downgraded to the (dead end) EB2? Or will they retain EB1C assuming the role is the same in the new company?

  • I'm kinda glad that "multinational manager" scam is having delays too. Give us any system and we'll abuse it.

Are startups getting it easily right now? What part of leading an team internationally are you missing? And if some engineer is able to get to a high level in pre-IPO Uber and getting $300k cash and lead a team, then they are million times more qualified than QA testers and IT managers that are getting it right now.

You will be downgraded AFAIK because you left the employer that brought you in as multinational manager. New company can't file new EB1C I140 for you because you were not a multinational manager for that company. If it were after 485 filing, then you would have been OK.

Just wait for 6 more months, and then make the jump op. You are now eligible to cut the line;)

Did you have a H1B before? If not, you will need to go through all the lottery etc; if yes, you can do H1B transfer, but can’t work using receipt. You can keep you PD date as long as you leave the company 6 months after your I140 gets approved, but when the new company applies for you again, it won’t be EB1. I just did the transfer a few months ago.

@Google: Can you provide more details as to the circumstances that led you to change the employer rather than waiting for your PD to be current? When you changed the employer did you have to file in EB2/3 category but retain only the PD? Did your lawyer attempt any other route to speed up your GC process? Please share your experience as I think it will be super useful to many including me.
