Got offer from Google. I plan to join before H1B approval. I plan to quit job after H1B transfer receipt and take 2 weeks off and stay in the US. Is this going to be a problem? I am Canadian citizen, have H1B and approved i140 with LinkedIn. (I was born in China so I am backlogged on GC) Current TC 260K. Graduated from masters in Canada. Worked in US under TN for 1 year and switched to H1B after. 3.5 relevant YOE with 2 years as SWE at LI. Got offer from G for a L4 SWE position. (I will ask G’s lawyers. But they may not work in my best interest so I would like to hear your opinions.)
The only thing about H1B is paychecks. So here if you are going to be taking a 2 weeks vacation, you'll probably miss 1 paycheck if it's semi-monthly. So worst case, if you get an RFE during that period and they ask for most recent paystubs you might not have that but it's not very likely since the process is going so slow. But yeah, this is my opinion. I personally didn't want to do that so I am just gonna join on receipt but I don't think there is any harm in doing that. Good call on asking Google immigration.
So worst thing that happens here is you go back to Canada. Do it. How far you are from GC. There is no wait for Canadians.
Earlier some posted on Blind that his visa transfer to Google got denied
G lawyers said rejections are rare and are usually because of incomplete documents or something stupid.
Based on historical data of all time or historical data of last 2 or 3 months? And how do you know they won't do stupid things? Personally I won't take the risk
Canada: couldn’t you fall back on a TN?
That is possible although I am worried about immigration intent. I bought a house here in US and got I140 approved.
OP - what’s your current TC , relevant YoE and role - engg/ pm? Without these details it’s hard to give any suggestion
Mind sharing Google offer?
L4 155/330/75. I don’t have strong competing offers and I want to join G by Dec 2018.
Wow google L4 with 3.5 YOE. Heard they generally don’t do L4 with < 4 YOE. The process might take a month to get the receipt, so if you start now you should be able to join by Dec.
When did you initiate the immigration process with Google? I think takes over a month right
Hey OP! I am also a Canadian but born in China. I am in similar situation, except I have an offer from a company that's willing to wait for approval. But given the current timeline, that could take anywhere from 3 - 12 months.. I do not want to wait that long to leave my current job. So if we get denied and then company appeal and that gets approved, can we switch back to H1 status? I would not want to be denied, forced to leave country, come back on TN, and then have to go through the H1 lottery again. If I can get my H1 status back with ease, then maybe it is not that risky for me to just join on receipt?
I am pretty sure you won’t be subject to the cap when you repetition for H1B. but check with your lawyer to make sure. I am going to join on receipt. If denied I will try to get the TN at the border (which probably can be done during a weekend), and let my company repetition for my H1B.
Cool! I think you will need a lawyer prepared TN package as well - wont be as easy as just crosding the border without any documents IIRC
@dashazhu did you join on receipt
Do it.
