Hey Guys, Need your advise. I got laid off from qcom in April. Then, Applied for Oracle, and got job there in May. Oracle applied for my H1B transfer in June, and got RFE (Employer - Employee Relation) in July. Oracle attorney will take approx 2 months to file the RFE response in August last week. Now, My last day in Qcom is 28th September. Shall I tell my layoff story to Oracle HR/Attorney, and request them to file the response earlier on priority. And also, I have another offer in hand. Can I start my visa processing there as well. Thanks :)
I was in a very similar situation. I spoke to my lawyer on phone and told him of the situation verbally. They completed all the paper work much faster for me so that I don’t fall out of the 60 day window.
Thanks Doremon, I was afraid to discuss my layoff situation with Oracle HR/Attorney. But, now I shouldn't hide it anymore. Because it will make my situation worse.
I was afraid as well but I found that the lawyer was taking his own sweet time in each and every step and I was afraid that they will blow past the 60 day window. I was afraid to write things on email because it can be forwarded to god knows who. I politely asked for the lawyers number and then verbally told them about my situation. By the way.... I didn’t have an RFE. The lawyer was just very slow in creating my transfer case and I was almost close to blowing past my 60 day window.

Go someplace else that acts more reliably.
@Doremon2 How long you were in payroll after getting laid off.I heard that EMC keeps you in payroll for 2 more months minimum if you have visa issues
My old company laid me off instantaneously it was a startup. They didn’t keep me on payroll even for a single day .
Speak to a separate lawyer about it. Worth the couple hundred dollars.
Call whoever is handling your visa (hr & attorneys) better to tell them than to withhold information. People like people who communicate and who are honest
It's difficult times for visa transfer , i wish i had done the same. I let go of one offer and signed second, got denied post RFE and back to square one of interviews. Go with second place to sponsor/transfer too. Especially in your situation, create your own safety net incase RFE doesn't settle in your favor (don't judge your self over this move).
OP, any update?
Not Yet, Attorney will reply for RFE response in next 2 weeks. Its already been more than 50 days, and they are still working to prepare the RFE response :(

Wow what a trash lawyer and I've seen a lot of trash and a lot of lawyers in my life. I'm sorry but it's hard to solve this case given your dependency on incompetent bureaucrats.
Agree! I don't know why but most of attorney believe that they shouldn't respond to RFE in 1-2 weeks. :(
Im in the same situation. Got my offer letter today from Oracle and my last day at current company is Aug 20th. Oracle HR said background check by HireRight will take 5-7 days. And then H1B transfer review. Should I inform the HR about the layoff and ask him to expedite the H1B process?
