Work VisaJun 6, 2019

Received positive hiring decision, waiting for the offer but not US citizen and in need for a visa. What are my options?

I received a positive answer from a FANG company and they are now crafting my offer. However, I'm not a US citizen (EU citizenship). I've heard H1B is over for this year and I'm now wondering what my options are. I might qualify for O1. No idea if there is a cap as well. This would be my first application ever. If neither O1 nor H1B work, what do you think will happen? Do you know if it's common to relocate candidates for a year and bring them on a transfer visa? Or is it dead and I will need to apply again in some months? I interviewed for a position in their HQ in the Bay Area and it's planed I join one of the teams there. I'm keen to work with this specific team, it's a great fit, so relocating first to one of the EU office would not be the best option (9h time difference). They have offices in Canada but not with product teams. Were some of you in the same position? Do you think they might offer me to work remotely for a year or so? YOE: +10 Position: Sr. product designer Didn't study/graduate in the US, never hold a visa

Let them figure it out. They have the best immigration lawyers in the country

This is the most complicated area of an extremely complicated legal system. I assume your employer knows that you don't have status in the U.S., but if they don't bring it up, mention it. Do not send any information to USCIS or any other US government agency without talking to your employer's attorney or another good immigration lawyer. The most random things can cause processing delays and tons of extra paperwork. I know a lot of folks who work remote in Canada while waiting for visa stuff, it's definitely preferable to EU from what I've heard.

Thanks for the answer. Yes, they are aware. At the beginning of the interview process they made me fill information papers to see if I would qualify. The immigration team said it looked good. I assume they wanted to check before moving forward.

H1b is done for this year. I think since they interviewed you, they have a plan...

Update: it seems like I'm a solid case for O1. :)
