Recognition for my work after leaving the company

May 22, 2021 13 Comments

I developed state of the art algorithm in the field I worked in my company. My manager was not ok with me writing the paper at the moment as that would slow down the project and we had strict deadline.
Anyway, I plan to leave company soon and I expect them to publish the paper at some point in time. Can I expect to get recognition for my work? I understand that you give all rights to everything you develop to Microsoft by contract but at the same time I would expect to be writen in as author of the paper as I created the algorithm.
Is there something I can do to help my chances? Its a big breakthrough in the field and I would want to take credit for what I did.

Standard process for ex employees is all the broken stuff is your fault, and all the good stuff is my accomplishment.

Management will sense the reason of you leaving. I would say if the innovation is really that ground breaking, itโ€™s worth waiting.

Do you have time to file a patent?

Patents are not about money, you get mentioned as the author and inventor, which is recorded by gov agency.

Alternatively, open source is "kinda" a way to claim authorship and recognition, but you team and mgr should be open about publishing IP.

      Both ways take time...
If you don't want to lose it, stick around until it goes public in whatever shape you prefer.

    Stay for a little longer.

Only if youโ€™re 100% sure they will mention you as the creator if you do stay.

Talk to an MS patent attorney about a timeline to get a patent application in their queue. Figure out all whose approval you need to get a paper draft submitted for publication as an MS employee. Pick the path of past resistance.

Write on your time after work. At least get it out for review asap - would writing take that long? Do you need to run experiments/benchmarks to show the impact of your algorithm or is that already done?

Why would your manager care as long as youโ€™re meeting his deadline. Ignore the politics. Get your due, then get out. Donโ€™t let them rob you. If you have an offer in the pipeline ask if they mind waiting.

Patents are always political in MS, and there is a long-standing practice that your name is replaced if you leave the team. He also wonโ€™t be able to start up the process on his own if his manager wants to screw him over.
