S386: Level playing field

Last week met a coworker I had interviewed and hired about 2 years ago. They are on a much junior level, less education and half my TC. I have been waiting for more than 10 years now in GC backlog. They just received their Green Card (not indian).

I hope #S386 passes and there is a level playing field. No one should jump the line.

    I don’t even know what problem you guys have with Indians... the Indians here in the states are not into crime or drugs, pay the highest taxes and are good for the economy

    Is it the accent? A lot of us don’t even have that... (and even if we did, are you so shallow that it annoys you?).

      @ExxonM That exactly hits the nail on the head. If somebody asks why an Indian needs a tourist visa to visit the US and a German doesn’t, the official US Department of State explanation is that there were too many visa denials and overstays from India. That’s acceptable and not considered discrimination at the individual level.

      This law allows America to favor certain countries for travel visa free to America.

      According to Indians this is also discriminatory

    I think at the very least Indian people waiting for GC should be given an EAD with 10 years of validity. We are approved to get a green card so why not just give us the EAD.

      You mean they’ll have to pay higher wages to have American community college kids do mundane tasks like QA and database admins? That would be great. The backlog isn’t something that America needs to figure out. Folks who find themselves in a backlog of their own making simply need to make alternate plans... one that should include returning to their home country at the expiration of their temporary visas

      Plenty of college kids will work for 60k.
      In fact most ICC simply hire college kids in India and train them, there is no reason they can’t do the same here .

      There is no incentive to hire American kids because it easier to hire Indian cos Indians are willing to work as servants thanks to immigration carrot 🥕 dangled in front of them. This is a broken system that needs to be fixed.

    It’s not about the line though. Even for China, this problem is not that bad. Then why is it so much worse for Indian? The H1B fraud is going to continue. So even if this bill gets passed, even more will try to cheat the system. You guys will end up in the same place again in 5 years where the backlog is filled again. Fix the H1B first then this green card.

    I just have one question for you. Would you fight for this law after getting your GC? How many of them fight for this after getting a GC or US Citizenship. There lies the answer.
    Once it gets cleared for them, they forget about these laws. USA is a capitalist country, they give a damn whether you are in line with this law or not. This law could/will change only when there is an external pressure - when there are countries who outsource Indians more than America; and when America really thinks that it would be a huge issue if Indians leave for other countries- if there is a statistics somewhere that shows this.

    Think about it. We talk about it, but we all do the office work. If not, we have to leave the country. For the companies it is cheap and smart labor. All the companies will talk about H1B being a boon, and outward they would talk about the GC process. But all of them want H1B s and not GC.

      @GSD - Not sure you understood what I quoted there. The skin color does not matter here. Country of origin only matters. And no you can’t talk about equality if you were born in some other country. This is equality for them.

      No one force people into backlog. Black slaves were discriminated because of their color. And for the last time, Indians are "discriminated" against, in fact it's the opposite. There isn't a rule that says if you are Indian you must wait longer than others. Only because of moderation, Indians have to wait longer.

      The rule was actually put in place to prevent discrimination. S386 is asking US to discriminate against other countries simply because the immigrants of one country is significantly higher than others.

      This argument about how Indian consulting companies are abusing laws is getting very old now. Every time someone posts about s386 this has to come up. I agree with OP. The crimes of some should not impact all. The government here as the ability to figure out who the violators are.

    Show me one “fraud” from India who is not an actual engineer?

    On the other hand when a guy from literally any other nationality says “I have been doing drugs all my life, I dropped out of high school but now I did a boot camp and joined an IT company... people are all supportive and encouraging.

    Why this double standard?

      The article is biased and I can challenge almost all points listed there (except for the parts it says about higher Education and English skills, and H1B indentured servitude).

      One important conclusion I draw from above article is that 7% country cap is not helping the case of American diversity.

      And no, I am not from any of these Indian states article mentioned, as thousands of others in the backlog aren’t.

      @Microsoft, please refute. Because majority of the article are stats. Unless they are showing false stats, I seriously doubt you can challenge anything the article has to say. The "young" and "male" has been largely similar to other stats I've seen. I don't know anything about Indian states so the last point I don't know.

      @Nutanix - and what tell exactly? How is it going to matter? Do you think we Indians have not tried it for this long? Reps and senators will speak with care, but do absolutely nothing about any of these or try doing something only for their bosses/other members to veto out the move. Not going to happen

    What's wrong if employment visa system becomes majority IT? There are Indian doctors etc in backlog. Four companies with 1T market cap are IT and IT needs more immigration (not pizza shops or meat shops).

      Because this isn’t your country and we are not interested in changing the rules simply to allow uncontrolled migration from Indians only. There are African, European and Latin American doctors who are just as good or better. Indian doctors aren’t special. If they can’t wait, India has a dearth of doctors.

      Those 4 companies are US companies, founded and run by Americans.... i doubt they need that many Indian h1bs other than as cheap labor frankly.
