I am a Canadian citizen with a US green card. For family reasons, I need to work from Canada for 6 months of the year. Basically I want to work in the US for 6 months and from Canada for 6 months. I know that the US-Canada tax treaty requires the employer to switch to the Canadian payroll if I am present in Canada for more than 183 days. But I’ll be back in the US on the 180th day in order to avoid tax implications.

However, my current employer, Qualcomm, has a max of 90 days of working remotely from another country. That is not in line with the US-Canada tax treaty that allows up to 183 days. If more than 90 days, the HR case has to go to a committee that handles exceptions.

If this committee does not approve it, I may need to get a new job with a US employer who allows working remotely more than 90 days.

I am in hardware but I don’t need to work in a lab that requires physical presence. Which companies allow working from an international location (specifically Canada) more than 90 days?

For example, does Facebook allow this?

TC: $280K

I think I’ve read somewhere on Blind they also have the 90 day rule. I’ll search for it.
My other problem is I am based in the East Coast. So I also need to find out if a company like Microsoft agrees to a US address in the east for the 6 months in the US.

One Microsoft guy in this post says they allow 180 days in Canada. Great! The only issue would be the US address in the east.

I know it might be a dumb question but what if you don't disclose this information. Who is tracking your whereabouts?

    • Exactly but there are ways you can mask that, it’s difficult for Uncle Sam know about it technically he can but there are way bigger fish on his plate to catch , but I know that IT department of any company can find this out and report it to the HR department, then bippiti bapiti boo

I’m not sure if one can add another VPN before the company’s VPN in order to hide the Canadian IP address. But like you said it’s not worth it.

#nvidia and #facebook folks, does your company also have a time limit on working remotely outside the US? We have already established it is 180 days at Microsoft and 90 days at Qualcomm.

Update: Qualcomm’s 90 days max has nothing to do with working from Canada. They just want everyone back in the office soon. After phase 3, that 90 days will go down to 30 day max remote work from anywhere. Domestic too.
