I got H1B lottery but I can still extend my OPT to another 2 year because I have STEM major Personally I want to stay in OPT because of tax reasons but is this possible? Can I ‘defer’ my H1B activation to next year? Edit: Filed for consular processing

Cheapskate didnt want to pay Social Security and Medicare. You have no idea how lucky you are. Before i got my H1 I missed lottery twice (2007/2008) even with premium processing. If you were in front of me I’d smack you for being this dumb

Don’t listen to anyone above OP - I was in the same boat (not for tax reason, but because I wanted to travel out of the country in the summer before my H1B is activated) and it is possible activate your H1B later if you get the lottery. However, that requires you to have filed for “Consular Processing” and not “Change of Status” check with your lawyers what your filing was. Basically if you do Consular Processing, your H1B won’t be activated until you personally go to the US embassy in your home country. If you do Change of Status, it automatically converts to H1B on October 1. PM me if you want more detail

Check if your h1b was filed under counselor access or cos. Also, talk to your company lawyer and be open about it.
Check with your attorney if it was filed in consular processing. If yes, you can extend the date for h1b kick in, else it kicks in Oct. And don't pay attention to the trolls above on this post. Everyone is in different boats, and have different priorities. No question is stupid. You asked the right thing!

Basically you’re being told that the answer is based on something that you may or may not already have done, and highly likely not because of what wtfsnap said. We weren’t trolling. We were making a statement that whatever boat you are in, value your fucking h1b approval and it’s likely not worth the pennies you think you’re trying to save. Some of us got burned by this process and you sound ungrateful of that opportunity
Op once you are in the us for 5 years on f1 visa you are becoming a resident alien regardless of your status. Depending how long were your studies (bachelor vs masters) you can run out of time even with stem

Think big picture would you rather save 10k * 3ish today; and leave after 3 years losing the lottery or lose that to make almost 300k more over the course of the next 6 yrs!?
