The consequences of being fired in the US are much worse for people working on work visas.

There are laws that make it harder to hire people on visas, shouldn't there also be laws to make it harder to fire them?

Edit: Reason I ask is that employees with visas seem to be under much higher stress about getting fired and companies (mostly some managers in those companies) seem to take advantage of this

TC: 260k
YOE: 3
Visa status: TN (my question isn't related to TN status as I understand that it's not really a visa, but more for h1b etc.)

The unintended consequence (or feature, depending on who you ask) is that companies would shy away from hiring those on work visas

Yeah that's true. It definitely would shift the dynamic but just wondering if that dynamic would be fairer than the current one. USC / PRs would be less protected against getting fired, but the consequences for them would be much less too

How would you make it harder to fire? I can’t imagine a company having layoffs would want the optics of laying off only USC/GC in lieu of a mix so they would jump through all the hoops necessary to fire who needs to go.

The consequences of someone losing their job shouldn’t be a factor in the firing/layoff process. Because by that logic a USC with a family should be preferred over a visa holder with no kids.

  • I can assure you getting fired as us citizen is the same as any other employee on a visa or not.

I’d be on board with expanding the timeframe to get a new job (no clue how long it is now) or something similar which in my opinion address the actual problem rather than pushing it onto companies and changing the dynamics.

  • Hiring and firing shouldn’t be based on visas. Equal opportunity should work both ways

  • Cost of return flight ticket is something that already make it slightly harder.

Otherwise it’s job at will and AC21 portability act has solved this problem.

Why should people working on visa get any sort of advantage? They already have the privilege of being here.
