OP, check out visa bulletin https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2019/visa-bulletin-for-august-2019.html (you want "FINAL ACTION DATES FOR EMPLOYMENT-BASED PREFERENCE CASES" table) to get an idea of wait times.

EB1C process took ~15 months in my case including fighting one RFE.

Thank you! Very interesting. Have you applied as a functional manager or as someone with direct reports? PM me if you don‘t want to expose. Thanks

Both, head of analytics / data team manager with direct reports at my company. In my case I've provided extensive proof of being manager at L1A stage (because they requested more details via RFE), so it wasn't a problem at EB1C stage.

If I were you, I would consult with 3rd party immigration lawyer to get a second opinion on EB1 vs EB2. Because on the one hand (1) they approved your L1A visa so it seems that they agree that your position is managerial and (2) you are with Microsoft which should make USCIS less suspicious, on the other hand not having direct reports can make them wonder.

Why do you want to try EB1, you can get GC in EB2 around the same time. It’s not worth it if you are not born in India or China

    • Why? what happened. If 3 years is a big surprise in length to you, who told you it was quicker? A shit tonne of paperwork happened. Requests for more evidence for people/functional manager. PERM Labor cert, then I-140, then EAD with AP, then I-485 AOS. Enjoy the inner workings of USCIS and be glad we have it so easy.
