Solution to H4 EAD and spouse related VISA

There are debates about this. I think I have a middle way. FYI I already have a green card so my intentions are pure. Best strategy is if your spouse has H1B visa then Employer can file H1B visa for you (h4) with cap exempt. This would allow spouses to only take jobs that would require H1-B but without the hassle of lottery and also protect lot of American jobs since I see H4-EAD folks working in Macy’s/Bank etc which is clearly meant for Americans only. What do you guys think of this ? I am planning to meeting congressmen for this just as my suggestion. But your input can help.

This is the long term solution. But even if they change this today lot of Indians would have to wait a good 5-10 years at least to get GC

H1B without lottery for spouses of h1b who has I140? I like it. This way people only get jobs that match their skills and not do anything and everything. Case closed

Good point but I wasn’t sure to put approved I140 as requirement but I think that’s for current H4 eligibility requirement so that should work. Thanks for catching the details

Why do they need to work h1b like job? The problem is greencard wait time. People from other countries get greencard and then citizenship while Indians have an infinite wait.

Let’s keep green card as a separate thing , we aren’t here to discuss green card laws. If there is country wait time for green card then that should be addressed in that law , I don’t think that should be related to h4 ead. Green card is way to citizenship so there are different requirement for that like maintaining diversity of countries etc . Work visa is currently not based on country and we would like to it merit base and not country base

Kids are born as citizen and as citizen you have the right to work anywhere . Don’t put your sentiments behind this , we are designing a law so we have to look at a bigger picture

What's the incentive for anyone other than people who are affected (non citizen Indian women and their husbands) to support this? Laws happen in this country after lot of lobbying and that needs either lot of voter support or corporate America support. This proposal would not have enough of either.

Let’s not try to make a country thing, there is China , Mexico too but tomorrow there can be some another country too , let’s to fix or design the law fairly rather than having a country bias.

Won't work, companies don't file for h1b that easily however they do hire h4 ead much more easily.

Just give the Green Cards to the 500k or so people who want it and let them assimilate. Those people will be in the country anyway. Does the country really benefit by squeezing them to the bone and making their lives extra stressful and miserable vs just absorbing them and have them contribute their human capital fully?

@Lallon - For one, companies won’t like that. This backlog is the only way companies can somewhat hold back and retain talent. They have managed to create a pool of people who have lesser flexibility. This is great for their hiring. If GC is given, they will see their own ex employees start companies that compete with them. There are people stuck in GC backlog and in the US for over a decade. Simply pathetic situation, one thing positive is the USD earnings.
