Youtube literally has download button to watch it later. Why would they sue. Its their feature.
Using their download button will fall within the contracts they have established content owners, as there is no easy way to play the downloaded content outside the app. Downloading it as a file using 3p tools is a different story.
Legally speaking all videos on YouTube are copyrighted works because all works naturally have copyright on them without any action. The OP is leaving out some key facts to this story.

There isn’t a mechanism to easily track this, it’s unheard of. They have TOS policies against mentioning a means of downloading YouTube videos inside a YouTube video though. And routinely flag copyright violations for people who download videos and repost them on their own channel.
If it's on YouTube it's publicly available for download. But the question is about how you plan on using it. If you are going to download Coldplay concert and charge public for playing in your bar it's illegal (unauthorized distribution) Depends on your intent and what you plan on doing with content
