I have a few interviews lined up. Can I switch jobs while my H1B extension is pending with my current employer? The have filed in regular processing so the decision can take months. I've an approved I-140. My 6 years on H1B are done and visa has already maxed out in Nov'19. So current employer has filed extension based on I-140. Please guide. #h1b TC-110

Is ur current Visa valid. If so, yes u can. If not, the only reason u r eligible to stay is because of tat extension and I think u can’t switch. Better pay 100$ and get a online opinion from a lawyer on Murthylawfirm .
If your new employer applies for a h1b based on your i140 and gets approved then you can join them

I switched two companies using an approved I140z tats good but not with expired current H1b and pending extension . Better to get some legal advice .
Don’t switch company until transfer is approved. Ask them to apply and let you know once approved so that you can resign. Don’t quite current job before visa approved.
OP, if your current extension is rejected by chance and say the new employer's extension is approved, you will add some illegal stay to your residence here. You switch and the existing extension is approved and the new employer's extension is approved you won't have any issues or alternatively, can your new employer file your extension from you last petition expiry date ? If I were you, I would upgrade my current extension to premium and get it sorted before I start looking out.
