I just signed my offer for Google 3 weeks ago and an immigration consultant was helping me with getting a visa. I graduated from university with a humanities degree and the role is a program manager. The consultant told my recruiter yesterday that she cant proceed with getting me a visa because if education requirements for the tn visa. So now, my recruiter says they have to rescind the offer and see if we can team match with other teams outside of the US. i am a canadian and have over 7 years of experience. My boyfriend suggested that we take the offer letter( asking my recruiter to hold back on rescrinding until i try), job details, my transcript and go to a POE to try our luck there. does anyone have experience doing that? what additionals should i bring? i also have my certificate of project management as well as certified scrum master. i assume i should bring those as well. EDIT: i have been dealing with an immigration consultant and not a lawyer. i was told that the reason for denial cannot be shared with me and is private information???

Have you look at https://www.nafsa.org/_/file/_/amresource/8cfr2146.htm? Also depends on which occupation they are trying to file. I know people from Canada and Mexico on nafta without bachelor degree I believe only applies for “management consultant” and “computer systems analyst”. So if they thought of request a visa for you under either of those occupations, then you don’t need the degree. The usual requirement is 5 years of experience if you don’t have degree and you have 7 I’d reach out to the recruiter with this info. Maybe the consultant is not doing the job properly. Also it should be a paralegal/lawyer looking into this
I asked my recruiter if I can get more information around it and he was told by the immigration consultant that the reason for denial is private information. And that they can’t get me a visa at this point. Not a lawyer I’m pretty sure, the immigration consultant.
That unfortunately sounds like bullshit from google as you weren’t denied a visa. The “consultant” just decided for them.

Google interviews are team agnostic. Would you be willing to try to match to a team in Canada? They have offices there as well.
Yeah, my recruiter said he will start trying to find teams for me outside of us in canada or Europe or Asia, and also for Bay Area teams who might be willing to take me on remote for the first year and then do l1 for me.
Just do this. Don't jeopardize what could be a great long term career move for what would amount to working 1 year sooner at the HQ. L1 is a guaranteed path, and working 1 year from Canada or Europe isn't bad. It may be disappointing in the short term, but getting a gig with Google from a humanities background is worth 1 year of remote work. For what it's worth I've been advised even with a computer science degree from a top uni and a solid work history that a TN isn't a sure thing. I'm here on a L1 after working in Europe.
Just a note, if you get denied at the POE, it will be on your record that you were denied entry into USA. Confirmed by my lawyer.

Just try. It totally depends on mood of immigration officer. If you get rejected, you can try again and again and again.

Suggestion, go through a lawyer and have them mail in the application to get pre approved. If they decline, nothing goes on your record. Once you get pre approved you can show it at Poe or airport.
I think that’s what suppose to happen, but the immigration consultant basically said no we can’t do anything for her to get a visa.
Get a personal lawyer then or talk to hr. These people are hired by google, they are paid to do it. Or ask them why it can’t be done. If she doesn’t fit into any role that satisfies the tn status, then that’s a bigger issue, and she won’t be able to get a tn.

Xilinx, TNs have multiple categories depending on the profession. That is what SAP is asking.
