Does anyone have any affordable lawyer suggestions for a TN denial? Got denied at Toronto, I hear it’s notorious, for my dream role in user research :/
Did they tell you why you got denied? Does the role match your school degree? TN is really strict about that. Lots of random folks will study up on things like web development, land a job, but get denied the TN because of education mismatch.
There have been rulings/memos stating degree need not exactly match TN occupation, but a lot of agents seem to ignore them.
Exactly, I was denied on this basis. My degree was not considered relevant to graphic design TN despite it being cognitive psych :/ might a stretch but cmon you have to know how users think to do good work.
What your definition by affordable. Good lawyer is what you mean. Also your employer should sponsor it, should not he? I can ping you the name of a lawyer who did my H1b case in my previous job. I think she works with a lot of rfe / denials
sadly no :/. it’s through an agency for a long term contract at FANG and they’re being conservative with their resources so it’s all on me.
Get an H-1B. Not worth trying to sue CBP for making a decision they have a lot of discretion to make. TN is basically up to them.
What do you mean by sue? Can I not reapply at the POE? Or can I only appeal now?
Unless they basically banned you you’re free to reapply, but you may be flagged and get more scrutiny next time.
Who prepared your original petition? You should ask them for advice. The guidance I’ve been given as a previous TN holder is that if you get denied at the border application, ask to withdraw the application and the attorney will usually call the supervisors at the port to ask what additional evidence they need or why they denied you. You can definitely re-apply but you must do so with additional evidence or reasoning. Another thing that they could do is do the application by mail or use another TN job that might be more relevant to your education.
