Need help in handling h1b transfer scenario

Nov 9, 2021 11 Comments

Hello folks,

This is a question that has been asked quite a few times over in this platform. However, would like to get the opinion or learn about the experience of those who have been in this situation before.

I was in a situation to move from the current role and had to accept an offer from company A last month. The role and work wasnt my dream one however , had to accept as that was better than my current role and had to initiate the h1b transfer.

After a week, a recruiter from my dream company (company B) reached out and I was able to secure the offer for my dream role. The company A h1b transfer got approved on the same day I got the offer from company B.

Offer numbers are more or less the same. So money is not the factor here. Its the kind of role and my happiness being in a job i'm super passionate about is the factor.

As per the offer letter, the employment is at will. So I think reneging company A offer with blacklisting will be the only option and I understand that its a severe unethical thing to do.

Will there be any implications to the h1b transfer petition filed by company B in this case? Will they know about the already approved company A h1b?

I'm in a serious dilemma and dont know how to go about this. Would like to learn from anyone who has been through a similar situation.

If your next employer files for h1b and gets approved you are good to go.

Just delay the joining with company A, n have company B premium process your h1b.

Don't know yet but from my research it should go through okay since USCIS does not care how many petitions have been approved on your behalf.
