I got an offer from Microsoft. Being an immigrant on H-1B visa, MSFT had to transfer my H-1B visa. The H-1B visa transfer has been completed now. I don't want to have gaps in my employment and so the day I end my work at F5 networks, (current company) I would like to join Microsoft, the very next business day. I want to take a vacation to go to India before I join Microsoft. I will be using F5 networks' vacation (of course!). Which H-1B receipt will be used for the stamping? My new company's H-1B transfer receipt or my current company's H-1B receipt?
The one you work now not the future one. So whenever you go out again you ll have to carry the Microsoft approval if you have moved to Microsoft.
Indians and their fking H1B questions! Tc or gtfo btw
You don't need to comment if you don't want to. TC: $320K
Microsoft is giving you 320k TC what level is this ?
Consider talking to your lawyer from Microsoft for such advice.
You will have to get your stamping based on F5 paperwork. You will again have to get a new stamping based on Microsoft paperwork when this visa expires. You could have got a stamping based on Microsoft paperwork if you were residing outside of USA and then entering US as Microsoft employee. If you observe on the H1, you will see the company’s name. Now imagine you get your visa based on Microsoft, then try to enter the USA on that visa and then you show F5 paperwork at POE (you have to since you are still not MS employee)...that’s a conflict.
Thanks. You said that I need to take new stamping based on Microsoft paperwork when visa expires. What does this mean? Why do I need new stamping when visa expires and why not when I travel to India. Suppose I travel to India as Microsoft employee, while returning back to USA, I will have to get Microsoft visa stamp else on return to USA, my passport will still have F5 visa stamp but I will not be an employee of F5 rather I will be Microsoft employee. Simply put when will I need Microsofts stamp on my visa?
You don’t have to get MSFT visa stamp until your current visa stamp expires. You can show old visa stamp and new I797 approval notice at POE
But my current visa stamp will be for F5 networks. If I happen to travel outside USA before my visa expires and come back before my visa expires, without stamping then there will be a conflicts because my current employer will be MSFT but my current visa stamp will be F5.
Currently, I am in the same boat. Can you please share your experience and what did you do? Thanks.
OP, can you please update how did you proceed? I’m in the similar boat now and need suggestions. Thanks.
You should have a stamp with your current employer which in your case should be F5. The stamp depends on which approval notice 797 you have when you go to the embassy.
As I said I am already in F5 sponsored H-1B visa so I have the I797 from F5. I have another (second ) approval notice that is from MSFT because they transferred my H-1B visa. Now I have 2 H-1B receipts. One from my current employer,F5 and another from MSFT visa transfer. I never went to India after I received my H1-B visa and so I don't have H-1B stamp on my passport as yet. Which notice amongst the 2 will be used for stamping?
