I’m currently working with my employer and taking a planned vacation abroad. A new employer is agreed to transfer my visa and wait till the time it gets approved. I’ve my visa stamped till November 2019 and don’t plan to go for stamping. After returning from vacation I will continue to work with current employer till my transfer goes through. Is there any reason 1.) I shouldn’t travel? 2) I should not transfer before travel?
Do not travel unless absolutely required during Visa Transfers. Your transfer petition is considered abandoned. assuming you are on H1B.
If the receipt no is there for the transfer and then someone goes for a vacation I don’t know in what law it will be called abandoned! If you can explain or point me to something it will be helpful!
Well I am speaking from my transfer experience. This is what my immigration lawyer adviced me. Off course if you need to travel, please talk to your law firm handling transfer case for you. They would be the best source for details.
I am in the exact same situation except my current Visa stamped from previous employer expires in Sept 2019. The attorney at the new company that I will be joining suggested that they will file my application when I am back for travel. I am planning on going for Visa stamping when I visit India.
So are you transfering and also going for vacation?
Ask the lawyer at the company sponsoring the transfer. While you are still working with your current employer you’re fine. After your new employer received the USCIS notice then it should be fine too. Anything in-between these is risky you might get held up at the customs.
