I accepted the offer letter from Uber just before the holidays. The H1B visa transfer was in process. I got a RFE which has generally been the trend in the last few months. I was 25 days away from joining the team but @Uber retracted the offer. I was quite devastated because the entire process took around 5 months and I lost a lot of other job opportunities in the process. Is it legal to do so? Have some of you been experiencing the same? (Please know that I was told, Uber does not allow starting the work on the basis of the visa application receipt.)
It is unfortunate, sorry to hear that, but since California has at-will employment, both employer and employee can let go of each other at any point. So, legally speaking, yes they can do so. But yes, thanks for telling us about it, people will be careful.
Sorry about your situation. Uber is run by asshats. And you are not the first. Because of at-will employment laws, I don’t think what they did was illegal.
Was RFE so bad that the lawyers felt they could not get it approved and instead of risking rejection they instead opted to drop you?
^this. You can’t take sides till you see what exactly was in RFE.
Yup. They would have gone to great lengths to get it approved if you were already a good employee. The fact that they can just find someone else without risk of rejection means you lose out. This sucks of course if you are not already working at a decent job
Sorry to know that
But do you still keep your current job?
Yes! Thank god!
Sorry to hear that OP. I know for a fact that Pure Storage has retracted an offer in the past due to "internal changes in the team" or something like that.
I know of someone who was moving from Cisco to VMware. His h1 transfer got rejected with the reason "hire a local". He didn't have a degree from any US univ though.
Why did you get an RFE ??
The RFE was to cross verify the university coursework with the job duties.
Hmm, I am sorry to hear that.
Yeah! I made last minute international travel plans just to ensure that I can join Uber immediately without taking any breaks and ...
Wow, that's fucked up. But maybe you dodged a bullet -- women seem to have a bad time at Uber. See if any of your other options still stand?
